All insurance-related decisions, including eligibility, coverage, pricing, and policy issuance, are made solely by the licensed insurance agents, brokers, and providers you are connected with through our service.

Our service is provided free of charge to consumers. SmartHomeInsure may receive compensation from its partner agents and providers for referrals.

3. No Insurance Advice; No Guarantee of Coverage

The information provided on our Site is for general informational and advertising purposes only. It does not constitute insurance, legal, financial, or professional advice. You should consult with a licensed insurance agent or qualified professional for advice specific to your circumstances.

SmartHomeInsure does not guarantee that:

  • You will qualify for any insurance coverage
  • You will receive the lowest available rates or premiums
  • Any specific coverage, policy, or discount will be available to you
  • You will be connected with a partner in your area
  • Any partner will contact you within a specific timeframe

Insurance eligibility, coverage terms, rates, and premiums are determined solely by the individual insurance providers based on their underwriting guidelines, your property details, location, credit history, claims history, and other factors. SmartHomeInsure has no control over these decisions.

4. Eligibility to Use

To use our Site and services, you must:

  • Have the legal capacity to enter into a binding agreement

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SMARTHOMEINSURE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT:

  • THE SITE WILL BE AVAILABLE AT ALL TIMES OR WITHOUT INTERRUPTION
  • THE SITE WILL BE FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS

IN NO EVENT WILL SMARTHOMEINSURE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SMARTHOMEINSURE FOR USE OF THE SITE (WHICH IS ZERO) OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless SmartHomeInsure and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your violation of any applicable law or regulation
  • Any information you submit through the Site

Binding Individual Arbitration and Class Action Waiver

By agreeing to these Terms, you and SmartHomeInsure agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or your relationship with SmartHomeInsure ("Dispute") will be resolved exclusively through binding individual arbitration, except as specifically noted below.

Arbitration Process

Arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AND SMARTHOMEINSURE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may not consolidate more than one person's claims, preside over any type of class or representative proceeding, or award relief to anyone other than the individual party seeking relief.

Exceptions

This arbitration agreement does not prevent either party from:

  • Bringing an individual action in small claims court
  • Seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights
  • Bringing a claim in a court of competent jurisdiction for claims related to TCPA violations

Opt-Out

You may opt out of this arbitration agreement by emailing written notice to info@SmartHomeInsure.com within 30 days of first accepting these Terms or any material changes to this arbitration section. Your opt-out notice must include your name, address, and a clear statement that you do not wish to resolve disputes through arbitration. If you opt out, the remaining Terms will continue to apply.

Severability

If any portion of this arbitration agreement is found to be unenforceable, that portion will be severed, and the remainder of the arbitration agreement will continue in full force and effect. If the class action waiver is found to be unenforceable, then the entire arbitration agreement will be null and void, and disputes will be resolved in court.

13. Governing Law

These Terms and any Dispute arising out of or relating to them will be governed by and construed in accordance with the laws of [STATE OF INCORPORATION], without regard to its conflict of law principles.
